How to legally (via HOA?) decrease the # of rental units w/i our condo complex.Want owner occupied vs rentals?

Need info regarding how to legally change the rental vs home owner occupied percentages within our condo complex. Can "owner occupied" be inforced or is this considered discriminatory? Any info regarding how to undo the current trend will


You will need to modify your covenants and then record the amendment. Read your covenants and figure out how many owners must approve this change. Hold a vote. If you get the correct number of votes, commission a real estate attorney to draft the change.

I’m back….

Well I must apologize to ANYONE who might be reading this blog. Not much content, huh? Nothing exciting? Well my only excuse is that I have been busy keeping up with the hot real estate market in Denver – listing properties, getting them sold, showing homes to buyers and getting them under contract and getting THOSE houses sold… plus managing my growing Property Management business.

Given all of that activity, something happened yesterday that I thought I would share. I was showing a really neat condo for rent in the Hunter Run complex in Denver – sort of a hidden jewel. The young lady who was viewing it was telling me about other properties that she is considering.

Now mind you, she has been booted OUT of her last 2 rentals but not for non-payment but because of owner issues. The FIRST one went into foreclosure about 4 months after they got into the property. Then the 2nd one is now being put up for sale by the owner and they have to get out by the end of April.

So in an effort to locate another place, she went online, did her research and ended up landing on MY website where she was able to see about 15 pictures of the condo – the online ads only allow me to post 5 pictures at a time and we all know, pictures tell the story!

Anyway, when I asked her how many other properties she has seen, she told me MINE is the only one! The REASON is that I AM THE ONLY ONE WHO CALLED HER BACK and she said she was “shocked” by how quickly I responded to her inquiry! Now I AM the sort of person who does check my email and my iPhone quite regularly. Maybe it was 10 minutes before I got back to her? But the fact that it was even within 24 hours was astonishing to her.

Then our discussion continued when she saw the CO monitors in the rental unit – which is required by LAW effective July 1st of LAST YEAR. She told me that her property owner made HER buy the CO monitors and she will be taking them with her. THEN she told me how her sink at her current rental has been leaking underneath for MONTHS and is developing mold and the owner is STILL NOT TAKING CARE OF IT. I told her about the “Warranty of Habitability” and what the owner’s responsibilities are and what her rights are.
